Justice of the Peace

The 10276NAT Course in Providing Community Justice Services (Commissioner for Declarations) (Justice of the Peace [Qualified]) provides participants with the knowledge and skills to assist them in their community volunteering responsibilities of witnessing documents and minor judicial duties. This 2-day course enables eligible applicants to apply to become a Justice of the Peace (Qualified) or a Commissioner for Declarations – the Department of Justice and Attorney-General will charge an additional fee for your registration.

For anyone wishing to become a Commissioner for Declarations only, the unit for this qualification is covered in the first day of the 2 day Justice of the Peace course and can be completed on its own at a cost of just $240.  Assessment is completed by open book, question and answer, during the 2 days.  This course can also be completed by distance learning.  (Once you click on Book Now, choose the closest Intake Date to when you want to start – the Intake Date is only for our office purposes, you are welcome to start the books as soon as you have made payment.)

  • JUSDEC001: Perform the Duties of a Commission for Declarations, and
  • JUSJPQ001: Perform the Duties of a Justice of the Peace [Qualified]

Anyone interested in becoming a Commissioner for Declarations (duties include witnessing signatures on a wide range of documents, and certifying copies of documents), or a Justice of the Peace (Qualified) (duties include those of a Commission for Declarations, as well as issuing summons and warrants, justice examination orders, executing minor bench duties, bails and sureties).

You cannot apply or hold office as a JP or Cdec if you:

  • have been convicted of a serious offence at any time (i.e. an indictable offence, irrespective of whether it was dealt with in the magistrates, district or supreme court)
  • have been convicted of more than 2 offences of any kind at any time
  • have been convicted of an offence of any kind in the last 5 years
  • have been convicted of an alcohol or drug driving offence in the last 5 years
  • have been convicted of more than 2 traffic offences in the last 4 years (i.e. convictions under the Transport Operations (Road Use Management) Act 1995)
  • are an undischarged bankrupt (i.e. not yet free from bankruptcy).

Also, if you have been convicted of more than 6 offences under the Transport Operations (Road Use Management) Act 1995 in a 4 year period, you are not qualified to be appointed as a JP or Cdec for 5 years after the date of your last conviction.

Examples of offences include all types of criminal offences, drug related offences, financial (tax or business related), social security offences, shoplifting, or failure to pay a TOLL fee within the stated period of time.

Note that for traffic offences, a person who pays an amount by the way of a penalty for an offence, is taken to have been convicted of the offence on the day the amount is paid.

Upon successful completion of the course, participants will be given an examination to complete and submit for assessment. Once marked competent, within 5 business days participants will be mailed a Statement of Attainment—this can then be submitted to the Department of Justice and Attorney-General along with your Justice of the Peace application (with 2 referees and proof of Australian citizenship), and registration fee (approximately $124.70).  JP and Cdec stamps are available to purchase online here.

This 2 day course costs just $340 (or $240 for just the Commission for Declarations component). Fee is comprised of: $100 non refundable registration fee, $20 resource fee, and $220 tuition fee. Includes all required text books, and tea and coffee.

The Justice of the Peace course can also be completed by distance learning at a cost of $320, or $220 for the Commissioner for Declarations course.  Note there is a $10 postage fee if you wish for us to print and post the books to you.

We also recommend a minimum Grade 10 level of English reading and writing.

Participants must be:

  • An Australian citizen
  • 18 years of age or older
  • Of good character
  • Registered on the state electoral roll
